SPACE – TERMS OF SERVICE

By accessing, browsing, or purchasing from this website, you agree to be bound by these Terms of Service.
If you do not agree, please discontinue use of this site immediately.

1. Age Requirement & Legal Use

1.1 You confirm that you are 18 years of age or older (or the legal age of majority in your jurisdiction).

1.2 Space reserves the right to delay, decline, or cancel any order for the purpose of verifying your age and identity.

1.3 You understand that whipped cream chargers contain nitrous oxide (N₂O).
By purchasing from Space, you confirm that:

  • You are not purchasing products for the purpose of inhaling N₂O.

  • You acknowledge that inhaling nitrous oxide is dangerous and may cause serious injury, permanent health damage, or death.

  • You agree that Space is not liable for injuries or fatalities caused by misuse of any products sold on this website.

1.4 You agree that it is your responsibility to comply with all local, state, and federal laws relating to the possession and use of any product purchased from Space.

1.5 You confirm that you will not supply any of our products to individuals under 18 or anyone who may misuse them.
Space reserves the right to refuse service to anyone suspected of intending misuse or who is underage.

2. Shipping & Delivery

IMPORTANT: During events such as natural disasters, extreme weather, pandemics, transport strikes, or other force majeure disruptions, Space will notify customers of delays and provide available solutions.

2.1 Delivery Address

Orders will be delivered to the address supplied at checkout. Some products cannot be delivered outside Australia.

2.2 Dispatch Time

Orders placed before 2:00 PM AEST on business days are processed the same day and typically dispatched the same day, depending on courier availability.

(A business day excludes weekends and public holidays.)

2.3 Delivery Issues

If delivery cannot be completed due to reasons under our control, we will contact you as soon as possible.

2.4 Failure to Accept Delivery

If you intentionally refuse delivery (not caused by Space):

  • Goods may be stored, and storage/insurance costs may be charged to you.

  • Goods may be resold, and after deducting reasonable expenses:

    • If you have not yet paid: we will deduct expenses and charge/credit the difference.

    • If you have paid: we will deduct expenses and return any remaining amount.

2.5 Order Cancellation (Consumer Rights)

If you cancel under applicable consumer laws, you must return the goods to us.
Failure to return items allows Space to deduct the cost of retrieving them from your refund.

2.6 Delivery Delays

Space is not responsible for loss or inconvenience caused by reasonable or unavoidable delays.
You will be notified of delays and may cancel your order at that time if desired.

2.7 Authority to Leave

All parcels are shipped uninsured with Authority to Leave by default.
For insurance or signature requirements, email: sales@spacewhip.com.au (or your correct store email).

2.8 Estimated Shipping Times

Courier delivery times are estimates only, not guarantees.
Delays may occur, especially during peak periods (e.g., Christmas).
Space is not liable for delays caused by third-party couriers.

2.9 Remote Areas

Remote or regional locations may experience extended delivery times.
If you need your order by a specific date, please contact us before purchasing.

2.10 Processing Fee for Cancellation

Orders cancelled within 48 hours of purchase will incur a merchant processing fee.

3. Warranty & Responsibility

3.1 To the fullest extent permitted by law, Space disclaims all warranties—express or implied—including warranties of merchantability, fitness for a particular purpose, or non-infringement.

3.2 Space does not guarantee the accuracy, completeness, or usefulness of any information on this website.

4. Indemnification

You agree to indemnify, defend, and hold harmless Space, its staff, and its affiliates from any claims, damages, losses, or expenses—including legal fees—arising from:

  • Misuse of products

  • Breach of these Terms

  • Violations of law

  • Incorrect information provided during a purchase

  • Purchases made on behalf of third parties

If you purchase on behalf of someone else, you are responsible for ensuring that they understand and accept all applicable terms.

5. Entire Agreement

These Terms, along with our Privacy Policy and any documents referenced herein, constitute the entire agreementbetween you and Space and supersede any prior written or verbal agreements.

If any clause is determined to be invalid or unenforceable, the remaining clauses remain fully effective.

6. Governing Law

These Terms are governed by the laws of New South Wales, Australia.
You agree to the exclusive jurisdiction of NSW courts for any disputes relating to these Terms or your use of this website.

7. Terms of Sale

7.1 Business Sales (B2B Only)

Space supplies products primarily for the hospitality, food, and beverage industry.
We sell only to:

  • Food-related businesses

  • Businesses with an active ABN

  • Verified companies operating in the food/hospitality sector

7.2 Over 18 Requirement

Products are not for sale to minors.
We may require ID verification before delivery.

7.3 Resellers

Resellers must ensure all customers are 18+.

8. Misuse Policy

Misuse of nitrous oxide is dangerous, illegal, and harmful.
Do NOT inhale gas.

Products must only be used with:

  • Approved whipped cream dispensers

  • Approved multi-use dispensers

NO other devices are permitted.

Space may refuse sale if misuse is suspected.

If you suspect nitrous oxide abuse by someone you know, please contact us immediately.

8.1 Restricted Delivery Locations

N₂O products will NOT be delivered to:

  • University dormitories

  • Colleges

  • Schools

  • Hospitals

  • Any location suspected of misuse risk

9. Recycling

All chargers and cylinders are made from 100% recyclable steel.
They are not refillable.

  • Dispose of empty cartridges with household metal recycling.

  • Do not dispose of partially filled cartridges.
